These Terms and Conditions govern your use of EliteLinks App provided by EliteLinks. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

  1. License to Use

    2. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

  2. User Accounts

    3. Some features of the App may require you to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

  3. User Content

    4. You may have the opportunity to submit, post, or display content, including but not limited to text, images, or other materials ("User Content") through the App. By submitting User Content, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such User Content in connection with the App.

  4. Intellectual Property Rights

    5. The App, including its content, features, and functionality, are owned by the Company or its licensors and are protected by intellectual property laws. You may not modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the App.

  5. Privacy

    6. Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information in accordance with our Privacy Policy.

  6. Prohibited Conduct

    7. You agree not to:
    Use the App for any illegal purpose or in violation of any applicable laws or regulations.
    Impersonate any person or entity or misrepresent your affiliation with any person or entity.
    Interfere with or disrupt the operation of the App or servers or networks connected to the App.
    Use any robot, spider, or other automatic device, process, or means to access the App for any purpose.
    Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App.

    8. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

    9. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLES, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE APP.

  9. Governing Law

    10. These Terms shall be governed by and construed in accordance with the laws of California, United States of America and for anyone outside of the US, without regard to its conflict of law provisions.

    11. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

Disclaimer and User Agreement

By signing up and using our mobile app for purchasing golf memberships and guest privileges, you acknowledge and agree to the following:

  1. User Responsibility: You understand and agree that as a user of our app, you are solely responsible for your actions and decisions regarding the use of the purchased memberships and guest privileges.
  2. Assumption of Risk: You acknowledge that participation in golf activities carries inherent risks, and you voluntarily assume all risks associated with such activities, including but not limited to property damage, personal injury, or any other loss.
  3. Release of Liability: To the fullest extent permitted by law, you release and discharge us (the seller) from any and all claims, demands, damages, or liabilities arising out of or in connection with your use of the memberships and guest privileges purchased through our app.
  4. No Warranty: We make no warranties, express or implied, regarding the suitability, reliability, availability, or accuracy of the memberships and guest privileges sold through our app. All purchases are made at your own risk.
  5. Indemnification: You agree to indemnify and hold us harmless from any losses, damages, or expenses (including attorney's fees) arising out of or in connection with your use of the memberships and guest privileges purchased through our app.
  6. Compliance with Laws: You agree to comply with all applicable laws and regulations while using our app and participating in golf activities.

By clicking "I have read and agree of the Terms of Service" or by continuing to use our app, you signify your acceptance of these terms and conditions. If you do not agree with any part of these terms, you may not use our app or purchase memberships and guest privileges through it.
